Agreements

Studio Liability Waiver and Release

Independent professional. I rent the studio to deliver my own services to my own clients. I am not an employee, partner or agent of the studio.
Assumption of risk. I understand that physical training, massage therapy and the use of gym equipment carry a risk of injury, and I accept that risk for myself.
My clients. I am responsible for screening my clients, obtaining their own health questionnaires and waivers, supervising them during sessions, and giving first response if anything goes wrong.
Release. To the extent permitted by Malaysian law, I release the studio owner, Topman Health and Fitness, from claims for injury, loss or damage arising from my use of the studio, or my clients' use of it during my booking, except where caused by the owner's negligence.
Indemnity. I will indemnify the studio owner against claims brought by my clients that arise from the services I provide, except where caused by the owner's negligence.
Insurance. I understand the studio's insurance does not cover my professional services. Professional liability insurance is recommended for my own protection.
Fitness to work. I am fit to deliver my services and will stop any session that becomes unsafe.
Emergencies. I know where the first aid kit and exits are, and will call 999 in an emergency before contacting the studio.

I have read and agree to the Studio Liability Waiver and Release.

Facility Responsibility Acknowledgment

Booked time and zone. I use only the zone I booked, and arrive and leave within my booked window.
Reset after use. I re-rack weights, return bands and attachments, wipe down benches, mats and the treatment table, and take everything I brought.
Using equipment. I check equipment before use and use it within its limits. Only bumper plates may be dropped.
Faults and damage. I report any fault or damage straight away on WhatsApp and do not attempt repairs myself.
Paying for damage. I pay for repair or replacement of anything damaged beyond normal wear during my booking, by me or my clients.
Door PIN and security. My door PIN is for my booking only and is never shared. I close the door properly when I leave. I understand CCTV operates in the studio.
Conduct. No smoking, vaping or alcohol. Clean indoor shoes only. Noise kept considerate when another zone is booked.
Who may enter. Only me and my booked clients. No subletting my slot without approval.
Belongings. Personal belongings are left at my own risk.
Breaches. I understand that breaking these rules may lead to suspension of my booking rights.

I have read and agree to the Facility Responsibility Acknowledgment. I consent to Topman Health and Fitness keeping my details and documents for the rental agreement, as described in the privacy policy.
